Formal Administration is the probate process that is used when the value of the probatable assets exceeds $75,000 and/or when there is a need for a Personal Representative to be appointed. The Personal Representative is responsible for ensuring that all debts of the decedent are paid and the balance of the estate is correctly distributed to the heirs and/or beneficiaries.
Summary Administration is an abbreviated probate process available for use only when the probatable assets are worth less than $75,000 or the decedent has been dead for more than two years and the decedent's debts have been paid, or creditors do not object.
Disposition of Personal Property Without Administration is another abbreviated probate process that may be an option if the decedent’s funeral expenses and medical and hospital expenses of the last 60 days exceed the amount of the assets you are trying to claim.
